If was a member of the U.S. congress* I would rewrite the Communist Control Act. This act is still current law but has never been used. Under the current wording of this act the Supreme Court would strike it down if it were attempted to be enforced because the Court would rule that it violates the first and fifth amendments.
In my version of this act I would allow the Communists or Socialists to exist as a political party with no requirement to register with the government. They would have freedom of speech and assembly. These changes would satisfy the Supreme Court’s constitutional objections of the original act. My new act would forbid any Communist or Socialist from holding any federal, state or local government offices weather elected or appointed and it would be retroactive to include any persons already elected or appointed.
My act would include the immediate removal from any office or appointment by a person who holds some government position while secretly being a communist or socialist. This removes the wolves in sheep’s clothing because their behavior would expose them for what they are. This would be a crime punishable by a $500,000 dollar fine and 40 years imprisonment. This should serve to discourage these wolves.
The rise to power in Nazi Germany was accomplished by peaceful and legal political processes and election victories. The Nazis did occasionally use violence but mainly relied upon a national socialism message. Overtime the party gained popular support during a time of economic hardship. This description of the rise of the Nazis in Germany is very similar to the rise of communism and socialism in the U.S. today. The question then is, will it be a repeat of what happened in Germany ?
My act would include the guarantee clause in article 4 section 4 of the Constitution that guarantees all states a republican form of government, showing that this republican form is the constitution of the United States of America. It would remind all that the oath of office they took includes the phrase, “to preserve, protect and defend the Constitution of the United States of America from all enemies foreign or domestic.” Allowing communists and Socialists, whose goals would destroy our constitution, to become a majority in our government is a violation of the oath of office.
My act would show the platform of the Democratic Socialists of America that states as their goals the following; abolish the office of President of the United States, abolish the Senate, abolish the military, abolish the Supreme Court, abolish capitalism, abolish prisons, abolish the police and abolish borders.
As can plainly be seen these goals not only violate the U.S. Constitution but are in principle insane and in practice dangerous. An overthrow of the government does not have to be violent, it can be peaceful if enough citizens are deceived into thinking that Communism or Socialism is a viable alternative to the U.S. constitution, similar to Nazi Germany under Hitler. The ignorance of the citizens cannot be an excuse or reason to allow communism or socialism to gain the upper hand over our constitutional republic. The citizens therefore under my act couldn’t vote for a communist or socialist because they would be forbidden to hold any government office, federal, state or local, elected or appointed.
Communists and Socialists are domestic enemies of the constitution. The only way to insure they never peacefully overthrow the government of the republic and scrap the constitution is to make them irrelevant and unelectable by our congress passing my act, the President signing it and the Supreme Court ruling it constitutional.
